Uber loses appeal as tribunal in the UK rules that it must treat its drivers as ‘workers’

Another important legal battle in the UK has been lost by Uber, after a London tribunal rejected its appeal against the verdict that it must treat all its drivers as ‘workers’. To do so would mean that all of Uber’s drivers in the UK would be entitled to minimum wage in addition to holiday pay, something which Uber, and the ‘gig economy’ as a whole is looking to avoid.

Government Consultation on Early Conciliation

The Government is consulting at the moment (and until 15th February) about their proposals for compulsory early conciliation efforts by claimants, whereby they will have to notify ACAS of intended tribunal claim in advance of lodging it.

Employment Tribunal Costs

The Government has now announced the new fee structure that will apply for Employment Tribunal claims. They have opted for a two tier system. Those claims that will be deemed First tier claims are straightforward cases such as claims for arrears of pay including claims for redundancy pay and notice pay. For first tier claims, there will be a charge of £160 to lodge a claim and a further £230 hearing fee payable when a hearing is assigned.
