Clinical Negligence during pregnancy

Scotland has one of the highest perinatal mortality rates in Europe.  Between January 2009 and June 2011 the NHS in Scotland paid out over £70,000,000 in damages in relation to negligence resulting in stillbirths and babies born with disabilities.  

While a damages claim provides little comfort to those who have lost children, it can significantly improve life for those children who survive with disabilities as a result of negligence.   The aim of the compensation is to place the disabled child as close as possible to the position he or she would have been had the negligence not occurred.   Damages can include claims for specially adapted accommodation, loss of earnings, transport costs, use of assistive technologies, physiotherapy, speech and language therapy and so on.  When a claim is successful awards are often split between a lump and annual periodical payments.
