Successful settlements include:-
£47,500 for a Joiner who fell from a ladder which slipped causing him to sustain a broken elbow and arm. His employers failed to provide him with the assistance of a colleague to safely foot the ladder. Following the rejection of a number of offers made by the Defenders, the Pursuer received £47,500.00.
£60,000.00 for a Joiner who suffered a serious wrist injury when he slipped on water on the floor of his work’s van, causing him to fall from the van. The seal at the foot of the door was defective and the Defenders (a local authority) were aware of this yet kept the van in commission. We raised Court proceedings for the member and rejected initial offers of £35,000.00 and £40.000.00 before ultimately negotiating a settlement of £60,000.00.
A Glasgow Joiner who suffered moderate hearing loss and troublesome Tinnitud due to long term exposure to excessive noise at work with Glasgow City Council/City Building (Glasgow) LLP received £10,000.00 as a result of a claim we dealt with on his behalf. Glasgow City Council/City Building (Glasgow) LLP admitted that they failed to provide adequate Hearing protection for the members.
An Aberdeen based painter received £9,500.00 including compensation following a road traffic accident in his work’s vehicle. The Third Party Driver’s insurers paid compensation, not only in respect of the member’s loss, injury and damage but also for tools and materials he lost in the crash.
£4,500.00 was recovered for a Dunfermline Union member who suffered a needle stick injury in the course of his employment with the local authority. The local authority failed to carry out an adequate needle sweep in a derelict property leading to the member sustaining a needle stick injury whilst removing a fireplace. The member suffered psychiatric injury as a result of this incident and we recovered compensation for that injury.
An Accord member slipped and fell at an outdoor event out with the course of her employment. She sustained a significant ankle injury. We raised a Court action on her behalf which was defended up to the date of the Proof at which point the Defenders agreed to settle the case with the member receiving the sum of £12,500.00 in full and final settlement of her claim.
An Accord member was involved in an accident at work when he slipped and fell in a bathroom at work. A tap had been leaking and his employers were aware of the problem but did not tend to it. As he entered the bathroom he slipped and fell on water sustaining a back injury. We recovered £3,500.00 in compensation for him.
A Production Supervisor employed by a building company sustained a serious injury to his left bicep when lifting a door sidelight weighing approximately 60kg. We raised Court proceedings on his behalf and successfully recovered compensation of £45,000.00 for the member.
A worker employed as a Banksman Slinger in Rosyth was injured when a steel support beam fell onto his right hand causing him to sustain injury to his ring finger and little finger. We pursued his employers and recovered the sum of £16,100.00 in compensation for him.
A UCATT member who was employed by a large building company was involved in an accident in Stornoway Harbour when a 15 tonne rig which had not been set up for operation properly, lifted off the ground and landed on his lower legs causing severe crush injuries to his legs and feet. We raised a Court action on his behalf and obtained an early admission of liability from the Defenders. The member suffered injuries which meant he was unable to return to his work and shortly prior to the Proof in his case the member’s claim settled with him receiving £500.000.00 in compensation for the loss, injury and damage he had sustained.
